Rescheduling & Cancellation Procedure

To reschedule or cancel either your photography or purchasing session, call 0457 396 652, additionally, email us on: [email protected] within seven (7) Business Days before your scheduled time. Please be mindful of weekends as these are not included in the “7 Business Days” and we will not receive your cancellation until office hours Monday morning.

***If you have called to cancel and have not received a response, it is essential that you email us so we have a confirmation of your cancelation. *** Cancelation, failure to show and changes of mind within the seven (7) Business Days will result in the full photography session fee being charged to your account.

Rescheduling Policy

If you find yourself unable to attend your scheduled session, we kindly request a minimum of 7 Business Days advance notice. This ensures that no cancellation fee will be incurred. Please be mindful of weekends as these are not included in the “7 Business Days”. As a small, owned business with limited portrait session slots, your cooperation in providing a 7 business days’ notice period allows us to potentially fill the time with another booking. Your understanding and consideration are highly appreciated. Session rescheduling is allowed once (1) free of charge if made seven (7) business days before your scheduled session. A wait period may be applicable in certain situations. Please note that if additional rescheduling is necessary or a change from weekday to weekend or change in session type, a fresh confirmation fee will be required and will automatically be deducted from your credit card upon your new rescheduled agreed date.

Rescheduling Due to Emergency/Illness

We understand that unforeseen situations, such as emergencies or illness, may arise. In such cases, we are committed to working with you to identify an alternative date that suits your schedule. If you need to reschedule due to illness or emergencies, your initial studio booking fee will be transferred to the newly selected date. Session rescheduling is allowed once free of charge if made seven (7) business days before your scheduled session. A wait period may be applicable in certain situations. Please note: if you have already rescheduled prior, an additional confirmation fee may apply at the discretion of the studio. Please note that if additional rescheduling is necessary or a change from weekday to weekend or change in session type, a fresh confirmation fee will be required and will automatically be deducted from your credit card upon your new rescheduled agreed date.

Gift Certificates

Your gift certificate must be presented at your photographic session or full session fee may be charged. Gift certificates are not valid in conjunction with any other offer. Gift certificates are not transferrable for cash or any other products. Gift certificates automatically include a studio session photography unless otherwise stated. Type of photography session allocated to you and availability for your session is at the discretion of our studio and what we see as suitable for you/your family. Any other inclusions or specifics must be stated on the gift certificate. Additional photos and products are optional and are at and extra charge as per price guide and are not included. Gift Certificates can only be used for a family photography session unless otherwise stated. Photography session must be taken within 6 months of gift certificate validation. Please take note of our 7 Business Day Cancellation Policy and reservation deposit that is required when we book you in. If you cancel your photography session within the 7 Business Day Cancellation Policy your gift certificate value/reservation deposit will be forfeited. All Gift Certificates are intended for the original recipient and cannot be “regifted”, passed on to another family or friend or exchanged for cash. Regifted gift certificates will be deemed invalid, and a full session fee will be charged.

eGift Certificates

All eGift certificates purchased do not include a physical product but an email and payment receipt which must be presented at the time if your photography session booking.

Physical Gift Certificates

Physical gift certificates ordered via email or by phone include regular postage unless stated. Express postage will attract an additional fee. If you would like your gift certificate express posted please indicate it in the comments  section when you make your purchase. Please note, we cannot guarantee exact date of delivery with Australia Post so please order ahead of time. We cannot guarantee delivery if details on form are not completed correctly or in full. Pickups from our Bossley Park studio can be arranged ahead of time.

Partner Gift Certificates

If you have received gift certificate from one of our partners, you must register your gift certificate to validate it before the expiry stated on your gift certificate. All partner gift certificates are valid in line with our general terms and conditions and require a booking deposit to proceed. intellectual
Property & Client Obligations

The copyright and ownership of all Intellectual Property prepared by Vivid Photography & Imaging Pty Ltd shall remain at all times vested in Vivid Photography & Imaging Pty Ltd.

Subject to the payment of all money that becomes due, Vivid Photography & Imaging Pty Ltd hereby grants the Client a revocable, non-exclusive licence to use the Photographs for the Permitted Use.

The Client irrevocably authorises Vivid Photography & Imaging Pty Ltd to publish, sell, assign, grant an interest in or use in any way whatsoever, either alone or in conjunction with others, the Photographs for any purpose in the studio’s sole discretion without notification or payment of any nature to the Client.

The Client waives any right, claims, or interest it may have to control the use of its identity or likeness and releases Vivid Photography & Imaging Pty Ltd from all liability arising out of the publication and/or reproduction of Photographs, and the data contained therein, in the private and/or public domains.

The Client will ensure that the Client and all Third Parties clearly credit Vivid Photography & Imaging Pty Ltd on any material, images, Photographs or the like that relate to the Photography Services posted to social media or other publicly available platforms.

The Client acknowledges that It is familiar with the  style of photography of Vivid Photography & Imaging Pty Ltd and is requesting the Photography Services with knowledge of the studio’s style.

The Client must not edit, change or amend the images in any way, including by:

(a) Adding filters to the Photographs; or
(b) Cropping the Photographs; or
(c) Causing or allowing the images to be cropped or a filter added to any of the Photographs.

Artistic Style and Creative Discretion

Photography is an artistic service and involves creative interpretation. By booking a session with Vivid Photography & Imaging, the client acknowledges they are familiar with the style and portfolio of Murielle Sassine and are commissioning the photographer with full confidence in her artistic vision.

The photographer retains full creative and artistic discretion in relation to:

  • composition
  • lighting
  • posing and direction
  • editing style
  • final image selection and presentation

As photography is subjective in nature, individual preferences may vary. Personal dissatisfaction with artistic style, creative interpretation, or image selection does not constitute a breach of contract and is not grounds for a refund, reshoot, or cancellation of any agreed purchase.

Book Purchases

All books purchased from our website are personally signed by Murielle Sassine. Under no circumstance do we offer a refund for any purchases made. All shipping is via Australia Post. Shipping times are a guide and we cannot guarantee delivery times.

Publication Accuracy

While every effort is made to ensure the accuracy of information contained in printed publications, including books, editorial features and promotional materials produced by Vivid Photography & Imaging, occasional typographical, editorial or production errors may occur.

Vivid Photography & Imaging shall not be held liable for typographical errors, spelling mistakes, incorrect names, captions or similar editorial inaccuracies that may appear in printed or digital publications.

Where an error is identified, the studio will make reasonable efforts to correct the error in future print runs, digital versions, or promotional materials where practical.

Such errors do not constitute grounds for refunds, compensation, or legal liability.

Black Friday Sale 

Our Black Friday Sale cannot be combined with any other offers. Black Friday Gift Certificates are non-refundable and cannot be exchanged for cash or other products. Complimentary or discounted product credits will only be applied once the client’s purchase order has been placed and finalised after their photography session.  These complimentary or discounted items are provided as a bonus with your photography purchase, in addition to your Black Friday Gift Certificate purchase.  If no photography products are purchased following the photography session, any complimentary or discounted Fine Art Prints or Product Credits will become void. You have 12 months to use your Gift Voucher from date of purchase. We have the right to refuse or cancel any vouchers if proof of purchase can not be provided. Only one voucher can be used per family session.

  1. Introduction

By entering any competition or giveaway (collectively referred to as “Competition”) organised by VIVID Photography & Imaging, operated by Murielle Sassine, Sydney’s premier women’s portrait photographer, you agree to be bound by these Terms and Conditions. These terms apply to all competitions, giveaways, contests, and promotional activities conducted by VIVID Photography & Imaging across all platforms including but not limited to our website, location based, social media channels, and in-studio promotions.

  1. Eligibility

To participate in any Competition, you must:

– Be at least 18 years of age or older at the time of entry, unless otherwise specified in the individual competition details.

– Be a legal resident of Australia, unless otherwise specified for international competitions.

– Not be an employee, contractor, or immediate family member of Murielle Sassine or any affiliated partners of VIVID Photography.

– Meet any additional eligibility requirements specified for individual competitions.

  1. Entry Methods

Entry methods may vary by competition and may include one or more of the following:

– Completing an entry form either in written or online entry form on the VIVID Photography website

– Voting for entries in gallery-style competitions

– Following, liking, sharing, or commenting on social media posts

– Submitting photos, testimonials, or other user-generated content

– Making a purchase or booking a service (where legally permitted)

– Referring friends or family members

– Email subscription or newsletter signup

Specific entry requirements, including opening and closing dates, will be clearly stated for each individual competition. Entry periods may vary from hours to months depending on the competition type.

  1. Entry Limitations

Unless otherwise specified:

– Each person is limited to one entry per competition

– Multiple accounts or fake profiles used to gain additional entries will result in disqualification

– Entries submitted outside the specified competition period will not be accepted

– VIVID Photography reserves the right to set specific entry limits for individual competitions

  1. Prizes and Prize Categories

Prizes will vary by competition and may include but are not limited to:

Photography Services: – Portrait sessions of varying durations – Photography credits to be used toward future sessions – Complimentary styling services (hair, makeup, wardrobe consultation) – Print packages and digital photo collections

Retail Prizes: – Gift cards from partner retailers – Beauty and fashion products – Photography equipment and accessories

Experience Prizes: – Complete portrait experiences including session, styling, and products – Behind-the-scenes photography workshops – VIP studio experiences

Prize Tiers: Competitions may feature multiple prize categories including major prizes, runner-up prizes, and consolation prizes. The number of winners and prize distribution will be specified for each competition.

  1. Winner Selection Methods

Winner selection methods may include:

– Random Draw: Winners selected randomly from all eligible entries – Public Voting: Winners determined by public vote during specified voting periods – Judged Competitions: Winners selected by VIVID Photography or appointed judges based on specified criteria – First Valid Entry: Winners determined by order of valid entry submission – Combination Methods: Multiple selection methods used within a single competition

The selection method will be clearly stated for each competition.

  1. Winner Notification and Announcement

– Winners will be notified via the contact method provided during entry (email, phone, or social media message) – Winners may be announced publicly via VIVID Photography’s website, social media channels, newsletters, at location or in-studio displays – Winner announcements will occur within the timeframe specified for each competition, typically within 7-14 days of competition close – If a winner cannot be contacted within 14 days of initial notification, or fails to respond within the specified claim period, the prize will be forfeited and an alternate winner may be selected

  1. Prize Redemption and Conditions

General Prize Conditions: – Prizes are non-transferable and cannot be exchanged for cash unless specifically stated – Prizes cannot be combined with other offers unless explicitly permitted – Prize availability is subject to business hours and appointment scheduling – Some prizes may have expiration dates which will be clearly communicated

Photography Service Prizes: – Photography sessions must be booked within specified timeframes – Sessions are subject to photographer and studio availability – Additional products or services beyond prize inclusions may be purchased separately – Styling services are subject to stylist availability and may require advance booking

Retail and Gift Card Prizes: – Gift cards and retail prizes are subject to the terms and conditions of the issuing retailer – VIVID Photography is not responsible for retailer policy changes or gift card issues

  1. Content and Image Rights

By entering competitions that involve submitting photos, testimonials, or other content:

– You warrant that you own all rights to submitted content – You grant VIVID Photography non-exclusive rights to use your submitted content for promotional purposes – VIVID Photography may use winner names, likenesses, photos, and testimonials for marketing and promotional purposes unless the winner specifically requests otherwise in writing – You are responsible for obtaining necessary permissions for any content featuring other individuals

  1. General Competition Management

Verification and Disqualification: – VIVID Photography reserves the right to verify the eligibility of all entrants – Entries deemed invalid, fraudulent, or in violation of these terms will be disqualified – Automated, bulk, or third-party entries are prohibited unless specifically permitted

Competition Modifications: – VIVID Photography reserves the right to modify, suspend, or cancel any competition at any time – In the event of cancellation, prizes may be awarded in a manner deemed fair by VIVID Photography – Changes to competition terms will be communicated through appropriate channels

Prize Substitution: – Prizes are subject to availability – VIVID Photography reserves the right to substitute prizes with alternatives of equal or greater value – Prize substitutions will be made at VIVID Photography’s discretion

  1. Technical Issues and Force Majeure

VIVID Photography will not be held responsible for:

– Technical failures, website downtime, or connectivity issues that prevent competition entry – Incomplete or corrupted entries due to technical problems – Events beyond reasonable control including but not limited to natural disasters, pandemic restrictions, or government regulations that may affect prize fulfillment

  1. Data Privacy and Communications

Information Collection: – Personal information collected during competition entry will be handled in accordance with VIVID Photography’s Privacy Policy – Information will be used for competition administration, winner notification, and prize fulfillment – Marketing communications may be sent to entrants who have consented to receive them

Opt-out Options: – Entrants may opt out of marketing communications at any time – Opting out of communications does not affect prize eligibility or fulfillment

  1. Limitation of Liability

By participating in any competition, entrants agree to:

– Release, indemnify, and hold harmless VIVID Photography, Murielle Sassine, and all affiliates from any liability, loss, or damage arising from competition participation – Accept that participation is at their own risk – Acknowledge that VIVID Photography’s liability is limited to the value of the prize offered

  1. Governing Law and Disputes

– These Terms and Conditions are governed by the laws of New South Wales, Australia – Any disputes will be subject to the exclusive jurisdiction of New South Wales courts – VIVID Photography’s decisions regarding competition administration and winner selection are final

  1. Terms Updates and Individual Competition Variations

– These general terms may be supplemented by specific terms for individual competitions – Where conflicts exist between general and specific terms, the specific competition terms will take precedence – Terms may be updated periodically with changes posted on the VIVID Photography website – Entrants are encouraged to review terms before entering each competition

These terms apply to all VIVID Photography competitions and giveaways unless otherwise specified.

Purchasing & Viewing Sessions

Purchasing Sessions

  • All clients are required to attend an in-person purchasing session at our studio (no Zoom, FaceTime, or online gallery options).
  • These sessions take approximately 1 hour and are held typically within 7–10 days of your photoshoot.
  • Orders must be placed during this session. Files are retained for 28 days from the day of photographic session.

Who Should Attend

  • All decision-makers should attend the purchasing session, including financial partners.
  • Please do not bring children to the appointment as they can be distracting.

Pricing & Orders

  • Refer to our pricing guide for information.
  • All orders are final once confirmed at your purchasing session. All signed off orders during the purchasing session are final and once signed off on cannot be changed in any way.
  • Additional purchasing appointments if required may incur a fee.

Image Review Period

Clients review and select their images during the in-person purchasing session. This appointment provides the opportunity to carefully review all images and make informed purchasing decisions.

Once the purchasing session has concluded and an order has been confirmed, the client acknowledges that they have had adequate opportunity to review the images and selections made.

Concerns raised after the purchasing session regarding image preference, artistic interpretation, or selection of images will not affect confirmed orders.

Payment Options

  • Full payment by EFT, VISA/MasterCard, debit card, or cash.
  • 50% deposit with the balance due on collection.
  • Direct Debit. Deposit is required upon set up.
  • Interest-Free Payment Plans. Deposit is required upon set up.

*Please note: Payment plans do not qualify for the $100 bonus gift/credit towards your package where applicable.

Cancellations & No-Shows

  • A minimum of 7 business days’ notice is required for rescheduling to avoid cancellation fees.
  • Missing your purchasing session without prior notice will result in the full session fee being charged.

Production Timeframes

  • Orders are typically completed within 6–8 weeks, depending on product type.

Usage & Conduct

  • Clients may not take photos or videos during photography or purchasing sessions.
  • Vivid Photography & Imaging reserves the right to use images for promotional purposes, including social media, unless otherwise agreed.

Client Conduct and Right to Refuse Service

Vivid Photography & Imaging is committed to providing a professional and respectful environment for both clients and staff.

The studio reserves the right to refuse service, terminate a session, or cancel an appointment if a client or accompanying person behaves in a manner that is:

  • abusive, aggressive, or threatening
  • disruptive to the photography session
  • unsafe to staff or other clients
  • in breach of studio policies

In such circumstances, any session fees paid may be forfeited.

The studio also reserves the right to refuse services where requests fall outside the photographer’s professional style, ethical standards, or studio capabilities.

Liability

Vivid Photography & Imaging takes all reasonable care in providing photography services and producing photographic products.

However, in the unlikely event that photographic materials are lost, damaged, corrupted, or not produced due to circumstances beyond the studio’s control, including but not limited to:

  • equipment failure
  • technical malfunction
  • illness or injury
  • weather conditions
  • venue restrictions
  • acts of God or other unforeseen circumstances

liability shall be limited to either:

  • rescheduling the photography session, or
  • a refund of monies paid for the affected service.

This shall constitute the maximum liability of Vivid Photography & Imaging Pty Ltd.

The studio shall not be liable for indirect loss, emotional distress, disappointment, or consequential damages arising from photography services or project participation.

Parents and guardians remain responsible for supervising children attending the studio or photography session locations at all times.

By booking and attending your session, you agree to the Terms & Conditions outlined above.

Session Fees and Product Purchases

The photography session fee secures the client’s appointment time, preparation, and photographic services provided by Vivid Photography & Imaging.

The session fee does not include photographic products, digital images, prints, artwork, or albums unless explicitly stated in writing.

Following the photography session, clients are invited to attend an in-person purchasing appointment where they may choose to purchase photographs, artwork, or digital image collections.

All product purchases are optional and made at the client’s discretion. Pricing and product options are provided prior to or during the purchasing session.

Once a purchase order has been confirmed and signed at the purchasing appointment, all orders are final and cannot be cancelled, changed, or refunded.

Charity Photography Project Participation Terms

(Applicable to all charity or fundraising photography projects conducted by Vivid Photography & Imaging Pty Ltd)

Project Overview

Vivid Photography & Imaging operates various photography initiatives designed to celebrate individuals, raise awareness for important causes and support charitable organisations.

These projects are independently created, organised, managed by Vivid Photography & Imaging Pty Ltd.

From time-to-time, at its sole discretion the studio may choose to support or affiliate with charitable organisations, including but not limited to breast cancer–related charities or other community organisations.

Any charity affiliation, donation structure or fundraising partnership connected with a project is determined solely at the discretion of Vivid Photography & Imaging.

Participation in a project does not create any direct relationship between participants and the affiliated charity.

Independent Operation of the Project

All charity photography projects, including but not limited to book projects, exhibitions, awareness campaigns and related photography sessions, are independently operated by Vivid Photography & Imaging.

Where a charity is referenced in connection with a project:

  • The project itself remains the intellectual property, confidential information and initiative of the studio
  • Any charitable affiliation or support is voluntary and determined by the studio
  • The studio reserves the right to select, change or discontinue charity affiliations at any time

Participants acknowledge that Vivid Photography & Imaging maintains full and sole control over the structure, administration and execution of the project.


Participation Fees and Donations

Participation in charity photography projects may require a booking fee, participation fee or donation-based session fee.

Participants acknowledge and agree by booking that:

  • The participation fee secures the photography session and project involvement;
  • Fees contribute to the costs associated with organising, producing, marketing and administering the project;
  • Where applicable, a portion of proceeds may be donated to a selected charity. That portion is at the discretion of Vivid Photography & Imaging.

The exact donation structure, if any, is determined by the studio and may vary between projects.

Participation fees are non-refundable once paid, except where required by law.

Charity Contributions

Where a project supports a charity:

  • Donations are made at the discretion of Vivid Photography & Imaging
  • Donations may ( or may not at all) consist of a portion of participation fees, product sales or project proceeds;
  • The studio may publicly communicate donation outcomes once they are finalised.

Participants acknowledge that not all funds collected through the project are necessarily donated, as costs associated with running the project must first be covered.

Image Usage and Publication

By participating in a charity photography project, participants grant Vivid Photography & Imaging permission to use their photographs, name, story or likeness for purposes related to the project and for marketing purposes.

This may include but is not limited to:

  • Charity awareness campaigns
  • Printed books or publications
  • Exhibitions
  • Social media promotion
  • Studio marketing
  • Media coverage or interviews

No compensation will be provided for such use unless otherwise agreed beforehand in writing.

Project Content and Publication

Participation in a photography project does not guarantee inclusion in any final publication, including books, exhibitions or promotional materials.

The studio retains full and sole editorial discretion regarding:

  • Image selection;
  • Story inclusion;
  • Design and layout;
  • Publication decisions.

Project Changes or Cancellation

Vivid Photography & Imaging reserves the right to:

  • Modify project details;
  • Adjust timelines;
  • Change charity affiliations;
  • Cancel or postpone or reschedule projects.

Where possible, participants will be notified of any significant changes.

Liability

While every effort is made to deliver projects as described, Vivid Photography & Imaging shall not be liable for any indirect loss, disappointment or change in project outcomes resulting from circumstances beyond the studio’s control.

Acceptance of Terms

By applying for or participating in any charity photography project conducted by Vivid Photography & Imaging, participants acknowledge that they have read, understood and agreed to these Participation Terms in addition to the studio’s general Terms & Conditions.
